Abstract

This paper addresses the way in which the penal system of the Republic of Kosovo regulates and implements the treatment of persons with mental disorders during criminal proceedings. Being one of the most sensitive and vulnerable groups in judicial processes, persons with mental disorders require special legal and institutional guarantees to ensure respect for their procedural and human rights. The study combines legal analysis, psychiatric approaches and biological elements that affect criminal responsibility, assessing the role of psychiatric expertise, the local legal framework and harmonization with international standards. Through the analysis of legislation, judicial practice and empirical data, the paper identifies shortcomings in the practical implementation of the law, the challenges of inter-institutional cooperation and the need to increase the professional capacities of justice actors. The results show that there is a discrepancy between the legal 6 framework and practice, as well as a lack of sufficient infrastructure and expertise. The paper concludes with recommendations for strengthening legal mechanisms, increasing the professionalism of experts, and improving the humane and effective approach to this category within criminal proceedings.
