Legal consequences of divorce as a cause of domestic violence in the territory of the Basic Court in Pristina in the years 2020–2024

Abstract

Domestic violence is one of the most serious challenges facing modern societies, leaving serious consequences not only on the emotional and psychological level of the victims, but also on the legal and social life of individuals. This phenomenon has also taken on large proportions in Kosovo, especially in the territory of the Basic Court in Pristina, where cases of domestic violence have increased significantly during the years 2020–2024. This paper aims to comprehensively analyze the legal consequences that arise as a result of domestic violence, with a special focus on cases that have ended in divorce. Through theoretical analysis, legal comparisons and empirical assessments, the paper examines the legal basis for treating domestic violence, divorce procedures in cases where violence is the main factor, as well as the civil, criminal and administrative consequences that affect not only the parties involved but also minor children. Empirically, the paper is based on statistical data and analysis of decisions of the Basic Court in Pristina, aiming to highlight the main trends and practical challenges in the implementation of the law. The purpose of this research is to contribute to a deeper understanding of the relationship between domestic violence and the legal consequences it brings, while also providing concrete recommendations for improving the legal and institutional approach to dealing with this phenomenon. The paper is drafted according to the APA citation system and is based on the legislation in force in the Republic of Kosovo, legal doctrine and the most advanced international practices for the protection of victims of domestic violence.
