    International Arbitration in Theory and Practice: Global Standards and the Case of Kosovo

    International arbitration has become one of the most important mechanisms for resolving disputes in international trade and investment relations. This paper provides a detailed examination of the concept, functioning, and advantages of arbitration as an alternative to traditional courts. Through analysis of international legal sources such as the New York Convention and the UNCITRAL Model Law, as well as the rules of key institutions such as the ICC, LCIA, and ICSID, the paper elaborates on the forms, procedures, and practical impact of arbitration. It further explores the advantages and shortcomings of this method, as well as Kosovo’s position in this field. The methodology includes theoretical analysis, comparative approaches, and interpretation of international practices. This study aims to offer a comprehensive overview for students, professionals, and policymakers on the importance of arbitration in the international legal order.

    The Institute of Administrative Silence of Kosovo in accordance European Union legislation and comparative aspects with Albania

    Administrative silence is a notion or a law institute known in the theory of administrative right, in the positive right as well as the international right, whereby the administrative law relationship of the concrete nature is created which is based upon general norm (law). In the Republic of Kosovo, by the new law on the general administrative procedure, the administrative silence has taken a positive ( approving) character, as compared to the old (abolished) law which foresaw the administrative silence with negative (denying) effect. Unlike the Republic of Albania, the positive administrative silence in Kosovo does not foresee exceptional cases, which means that for all administrative situations or issues, the administrative silence has the character of approving act in silence. The aim of this study is analysing the effects that the positive admnistrative silence has on the parties in Kosovo, as well as the comparative study with the law institute of the administrative silence in the Republic of Albania and directive of Europian Union about administrative silence institute.

    THE ROLE OF CIVIL SOCIETY FOR PREVENTION AND COMBAT OF VIOLENT EXTREMISM AND RADICALIZATION LEADING TO TERRORISM-WAR

    The civil society of different groups of actors, communities, and social formations, registered or unofficial, achieves responsibility and commitment in public life for the protection and promotion of values and common objectives for the good of society. Youth, women, and community representatives are the main actors in civil society that work to prevent and combat deviant phenomena in times of peace and especially during war, due to their influence and ability to promote social changes. Other interest groups, such as the media, law enforcement authorities, universities, researchers, and representatives of the academic world, as well as those involved in the private sector, can make important contributions to prevent wars and post-war events in crisis countries. The civil societies’ capacities in war and post-war countries can be strengthened by exchanging good practices for the programs of international institutions. Countries that have endured this situation, such as Kosova, Bosnja, Hercegovina, and Croatia, identify and support lesser known, reliable groups, creating networks and regional platforms for collaboration, and bringing professionals into contact with researchers and academics to gain results based on practical data and their implementation as soon as possible towards the countries in crisis.

    Economic Competitiveness Development Challanges in Western Balkan Countries

    This paper intends is to analyze and give a functioning overview of the national protection and competition development authorities in the Western Balkan countries. To explain how much these authorities are in compliance with EU rules and activities, to detail the implementation level of competition rules in the former Yugoslav Republics, to provide an overview how far these countries are in fulfilling their obligation based on Stabilisation and Association Agreement. Also, this paper intends to find the formula to build a strong and efficient National Competition Authorities as a prerequisite to ensure the effective implementation of the law on protection of competition and market economy functioning. Finally, the paper shows the level of implementation of competition rules from these candidate countries for EU membership in accordance with EU directives dealing with prohibited agreements, abuse of dominant position, concentration and state aid.     JUVENILE JUSTICE: KOSOVO CASE

    The paper evaluates policies and practices in juvenile justice from a comparative perspective. It is focused on an analysis of juvenile justice taking into account also work of prosecutors and the judges. In many states of Europe as well as in Kosovo there are developed strategies for reforms of the juvenile justice which have noted qualitative changes and with this, a distinct level of convergence between systems of European states is noted. By using the qualitative methodology and with the use of the method of comparative analysis and method of historical analysis, the authors will be focused on the historical development of the juvenile justice system in Kosovo, under the context of the development of this field in various states of Central and Eastern Europe. The findings and recommendations in this paper could enhance scholarly and institutional tackling of juvenile justice.

    Third generation of the human rights in Kosova and the positive discrimination

    Human rights in Kosova in the formal-legal understanding are sanctioned by the Kosova Constitution, within which there are incorporated most important international documents beginning with the Universal Declaration of Human Rights up to the European Convention for Human Rights. But nonetheless there are issues that remain still to be at the level of political debates and projections for future as well as there are issues that overcome the academic and theoretic debate taking the dimension overcoming the human rights. And this dimension from the practical viewpoint can overcome the accepted issue as it is positive discrimination at the determined moments and at the determined countries. The right to development, the right to environment, etc., as the rights of the third generation also in Kosova are at the phase which from the debate in order to transform into practical notions whereas positive discrimination under the current political developments time after time takes forms of overcoming the field of human rights and could endanger the Kosova state existence. Paper goal is to analyze Chapter of the Kosova Constitution related to human rights, to emphasize current formal-legal framework and the actual shortcomings of the rights from the third generation. Paper will underline the form and the level of positive discrimination in Kosova under the context of overcoming practical framework that are known in world related to this issue. It is un-avoided that the paper will come up with the recommendations which could be used in the theory and practice in Kosova.

    LEGAL-CRIMINAL POSITION OF MINORS IN THE REPUBLIC OF KOSOVO AFTER 1999

    By juvenile delinquency, we mean the antisocial and illegal behavior of minors. Young age is chosen with favorable rates in many countries. Usually, she does age 14-18 years. However, in the criminal-material, procedural and criminological literature, the term juvenile delinquency or young people's criminal behavior is often used. It is desired to emphasize the criminal activity of young people, which includes both juveniles and adults. Thus, the notion of youth criminality is used to emphasize criminal activity for all young people, regardless of age. In some cases, you also belong to the juvenile as a delinquent person, because there is a connection between the entire youth population, no matter what stage of age it is, from a biopsy and socio-cultural point of view, it has not yet been formed and therefore, a special approach and treatment is needed.

    Self-reporting of youth delinquency in the Balkans and beyond: Results of the ISRD3 International Self-Reporting Study of Delinquency in the Context of Violence, Victimization, and Substance Abuse in Comparative Aspects

    This article publications on the first results of the third International Self-Publikation Study of Delinquency (ISRD-3), a large international collaborative study of delinquency and victimization of 14- to 18-year-old students. The analysis is based on a sub-sample of the data set: 2060 respondents from 4 cities in the Republic of Kosovo. The prevalence rate of the main categories of delinquency in comparison to individual countries participating in ISRD3, as well as for 6 groups of countries, are presented as well as data on experiences of victimization (theft and robbery/extortion). Using different measures, we have compared the data with our country where there are significant differences in the level and type of offense found between groups of countries such as Europe, America and other countries. In this article, we compare the rates of offending and victimization found by ISRD-3 with other main sources of national statistics available in the Republic of Kosovo based on the police and the prosecutor. The article concludes with implications and suggestions for further research.

    IMPACT OF COVID - 19 ON THE INCREASE OF VIOELENCE AGAINST WOMEN

    The phenomenon of the domestic violence in Kosovo holds an important position in the positive legislation in Kosovo. This phenomenon apart from causing consequences to an individual as a victim, at the same time it causes consequences also for other parts of the family. Domestic violence has been present also in the past in the Kosovo families, but of course with lower intensity by keeping total discretion within the family whereas access of the society in this problem was very small. Violence against women is a complex problem which includes more than an act itself in the personal relations between the husband and the wife. It is a social problem of broad dimensions whose roots are found in the historic attitudes on women and the marriage relations. Socialization of men and women in our society and nomination of women in inferior position and rules that keep women economically dependent, makes women more vulnerable on violence committed by men with whom they live. This victimization of women from their husbands is strengthened from economic situation, mentality and tradition as well as not well awareness among the population on the domestic violence. A phenomenon which increased the number of various forms of violence against women is also Pandemic COVID - 19 who as the consequence of isolation of families within closed environments has had an impact to a category of irresponsible spouses to undertake various forms of violation against women. Violence against women is a serious problem and it deserves big attention of authorities (national and international).     Strategic and Implementation Issues Regarding ECB Monetary Policy

    This paper identifies the impact of the most important ECB‟s non-standard monetary policy measures in the euro area. The global recession has been reflected in the slowdown of the U.S. economy and the largest economies of Europe and Asia. The 2008 and 2014 financial crisis hit the European financial system, whereas during 2010 and early 2011 Eurozone faced the hardest time in the so-called debt crisis coupled with a drop in market confidence. Financial markets faced some problems of solvency of countries with higher debt and fiscal deficits, such as the sovereign debt crisis bubbles in Spain and Italy. The European Central Bank reacted by imposing strategic and technical measures to fuel the banks' liquidity needs, to fight a risky credit crisis and to restore investor‟s confidence within a heterogeneous Eurozone countries environment. The ECB implemented the unconventional measures, which aimed at lowering and flattening the yield curve by reducing the interest rate level and shrinking the gap between long- and short-term interest rates. The study can be applied to improve the monetary policy measures and reduce risks in the financial sector. The questions, which need to be addressed, relate to whether unconventional monetary policy works and what are the challenges in the long run.
